1. Scope of Application
These General Terms and Conditions (GTC) apply to all business relationships between d2mberlin GmbH (hereafter d2m) and the contracting party (Customer).
Conflicting or differing terms of the Customer do not apply unless expressly approved in writing by d2m.
By purchasing a ticket, the Customer accepts these GTC. Upon entering a venue, the applicable house and hall rules apply. The right of access on the event day lies with d2m.
2. Contracting Parties
d2m provides services in its own name and for its own account.
In some cases, d2m acts as an intermediary for third-party services. In such cases, the third party becomes the Customer’s contractual partner, and the third party’s own terms apply.
3. Contract Conclusion
A contract becomes binding only when d2m confirms an order or booking in text form (e.g. email) or dispatches the ordered tickets or goods.
Reservations and offers are non-binding until confirmed.
4. Prices and Payment
All prices and fees are shown in the respective offer or confirmation and include VAT.
Unless prepaid or otherwise stated, payments are due within 7 working days after receipt of the invoice.
If payment is not received on time, d2m may cancel the order after one reminder.
If direct debit or credit-card payments fail, the Customer bears any bank charges plus a € 5 processing fee unless lower costs are proven.
5. Retention of Title
Tickets and goods remain the property of d2m (or the third party) until full payment has been received.
6. Delivery and Event Dates
Delivery dates are generally non-binding unless expressly confirmed in writing.
Only the dates shown on the order confirmation or printed on the ticket are binding.
d2m and all promoters reserve the right to change the venue at short notice.
7. Cancellations, Lost Tickets, Liability
Tickets cannot be exchanged or refunded unless the event is cancelled or rescheduled by the organizer.
In such cases, d2m refunds the ticket price (excluding postage, fees, or travel expenses).
Lost tickets cannot be replaced.
d2m’s liability is excluded for ordinary negligence, except for injury to life, body, or health.
8. Right of Withdrawal
There is no right of withdrawal when purchasing event tickets (§ 312g (2) No. 9 BGB).
Tickets are time-specific leisure services, and EU law excludes withdrawal for such contracts.
9. Admission to Events
Admission is granted only to valid ticket holders as specified. Entry after the event has started is generally not permitted; re-entry may be allowed during intermissions.
Access conditions may be restricted due to applicable public health regulations.
10. Protection of Minors
Children under 6 years are not admitted to events intended for adults.
Children and teenagers under 16 years may attend only when accompanied by a parent or guardian.
The German Youth Protection Act (JuSchG) applies.
11. Health and Safety
Events may involve high sound levels that can cause hearing damage.
Customers are advised to use hearing protection and keep a safe distance from loudspeakers.
12. Recordings and Copyright
Audio, photo, or video recordings by visitors are not permitted.
During events, photo, film, and sound recordings may be made by d2m or authorized third parties for promotional purposes.
By purchasing a ticket, visitors consent to such recordings without further claims.
13. Security Rules / Items and Animals
Large bags (over DIN A4 size), weapons, sharp objects, fireworks, glass bottles, and cans are prohibited.
Bag checks may be conducted at entry.
Animals are not allowed; guide dogs must be arranged with d2m in advance.
Bringing food or drinks is not permitted.
14. Ticket Resale
Only d2m is authorized to sell tickets for its events.
Commercial resale or distribution by third parties is prohibited.
15. Personalized Tickets
If tickets are personalized, only the named person is entitled to attend.
d2m may request ID at entry.
If a non-authorized person uses the ticket, entry may be refused.
16. Ticket Transfer
Personalized tickets can only be re-assigned (re-personalized) on the event day at the venue, upon presentation of the original ticket and appropriate ID documents.
17. Data Protection
Personal data is processed in compliance with the GDPR and applicable German data protection laws.
Data is used solely for event purposes and not shared with third parties unless required for event execution.
18. Final Provisions
German law applies exclusively.
Place of jurisdiction is Berlin, Germany.
Any changes or additions must be made in writing.
